Preliminary summary

Pixxla s.r.o., with registered office: Vajnorská 135, Bratislava 831 04, Company ID: 53658981 (hereinafter referred to as “Owner”) as owner of a mobile container sauna, also known as Pixxla, processes personal data provided by a person interested in temporary rental of a mobile container sauna (hereinafter also referred to as “User”) exclusively for the purpose of the proper conclusion and performance of the loan agreement between the Owner and the User in accordance with § 659 et seq. The Civil Code, in particular the acceptance and confirmation of the sauna reservation, the necessary communication between the parties in the framework of the performance of the contract, withdrawal from the contract, control of the fulfillment of the terms of the contract, the possible exercise of claims, for the period resulting from these conditions. Personal data will not be used for any other purpose, disclosed or transferred to other countries.

The operator of the sauna is the Owner. For specific actions or activities related to the administration of the sauna and its use by third parties, the Owner will appoint an employee of the municipality or other authorized person (hereinafter referred to as “Authorized Person”).

Purpose of processing personal data

Execution of the loan agreement between the Owner and the User in accordance with § 659 et seq. The Civil Code, the subject of which is free use of the sauna — acceptance and confirmation of the sauna reservation, the necessary communication between the parties within the framework of the performance of the contract, withdrawal from the contract, verification of the fulfillment of the terms of the contract, fulfillment of other contractual obligations, possibly the exercise of claims.

    Legal basis for the processing of personal data

According to § 13 (1) (b) or 13 (1) (f) of the Act — the processing of personal data is necessary for the proper performance of the rental contract between the operator as the Sauna Owner (lender) and the data subject — the User (the lender), respectively in connection with such a contract and the existence of mutual claims from such of the contract, for the purpose referred to in paragraph IV above.

    Legitimate interests of the controller or a third party if personal data are processed pursuant to § 13 (1) (f) of the Act

The legitimate interest of the operator is the proper identification of the data subject — the User in connection with the performance of the loan agreement and the exercise of any claims from the loan agreement against the data subject, or with the legitimate defense against the claimed claims by the User, by appropriate legal means.

VII. Recipients of personal data

The third parties to whom certain personal data of the buyer will be provided are subcontractors of the operator, and this provision of personal data is necessary to ensure partial actions in the proper performance of the loan agreement between the operator and the data subject.

    All recipients of personal data are obliged to comply with all necessary security, technical and organizational measures to ensure the required protection of personal data, which will be used exclusively for the purposes resulting from these conditions.

The transfer of commercial data to a third country or international organisation is not carried out or intended.

    Retention period of personal data

For the duration of the performance of the loan agreement between the controller and the data subject and, where applicable, during the exercise of the claims under the contract against the data subject or by the data subject (e.g. for the duration of the relevant limitation period applicable in relation to the claims in question).

After the expiration of the period of storage of personal data, the controller is obliged to delete the personal data of the data subject.

    Instruction on the rights of the person concerned

Under the conditions laid down in the Act, the data subject has, in connection with the processing of his or her personal data:

  1. the right to request from the controller access to personal data concerning the data subject as well as other information pursuant to § 21 of the Act;
  2. the right to correct incorrect personal data or the right to supplement incomplete personal data (according to § 22 of the Act);
  3. the right to erasure of personal data (pursuant to § 23 of the Act);
  4. the right to restrict the processing of personal data (pursuant to § 24 of the Act);
  5. the right to object to the processing of personal data (pursuant to § 27 of the Act);
  6. the right to the portability of personal data, i.e. the right to obtain the personal data concerning it and which it has provided to the controller, in a structured, commonly used and machine-readable format, and the right to transfer such personal data to another controller (pursuant to § 26 of the Act);
  7. the right to withdraw your consent to the processing of your personal data at any time, in the same way as you gave your consent (pursuant to § 14 para. 3 of the Act);
  8. the right to file a motion to initiate proceedings on the protection of personal data pursuant to § 100 of the Act at the Office for Personal Data Protection of the Slovak Republic — in order to ascertain whether there has been a violation of the rights of the data subject in the processing of his/her personal data or there has been a violation of the Act or a special regulation in the field of personal data protection, and in case of detection of deficiencies, if justified and expedient, to impose measures to remedy or, where applicable, a fine for violation of this Act or a special regulation in the field of personal data protection.

The data subject may exercise his/her rights in writing to the above-mentioned postal address of the controller or to the e-mail address of the controller, where necessary further information on the rights of the data subject may also be provided to the data subject.

    Further information to the data subject pursuant to § 19 of the Act

The provision of personal data to the controller is voluntary, but it is a requirement that is necessary to conclude a purchase contract between the operator as the seller and the data subject as the buyer. As a consequence of not providing personal data, it is impossible to make a sauna reservation, and therefore to conclude and properly perform the rental agreement between the operator and the data subject.

Automated individual decision-making, including profiling, pursuant to § 28 (1) and (4) of the Act is not applicable.

XII. Security of personal data

The controller declares that it has taken all appropriate technical and organizational measures to secure the personal data of the data subject.

The operator has taken technical measures to secure the data repositories of personal data, in particular ensuring access to computers by passwords, the use of an antivirus program and regular maintenance of computers.

XIII. Final provisions

By properly making a sauna reservation by sending the completed reservation form on the Booking page, the data subject (User) confirms that he has been acquainted with the conditions of personal data protection and that he accepts them in full, in a valid and effective version (as of the date of confirmation by the data subject).

These terms and conditions of protection of personal data come into force and effect on May 1, 2019.
